What is a PSPO

    Public spaces protection orders (PSPO'S) are laws under the Anti-Social Behaviour, Crime and Policing Act 2014 which ban specific acts in a set (designated) area in England and Wales. 

    They apply to everyone and are aimed at tackling nuisance behaviour. There are penalties for breaking the conditions set out in the order including (Fixed Penalty Notices (FPN)) fines.

    In this case we want to address the cycling, scooting and skating in the shopping areas in the City Centre.

    Do police already have these powers?

    Police have limited powers, but these only apply after an accident or incident has been caused by cycling, they are short term and do not prevent further issues.  If the PSPO is amended as proposed these incidents are less likely to happen.

    Has the decision already been made?

    No, elected members will meet in due course to discuss this matter, the meeting agenda and reports will be publicly available in advance of the meeting.  

    Members will have a range of options to consider in relation to the existing PSPO, from leaving existing conditions as they are or amending as they feel is appropriate.  They will consider the results of this survey as part of that process.

    What is happening with these responses?

    The responses will form part of a report for elected members to consider whether to amend conditions within the existing City Centre PSPO.

    Are there time restrictions on a PSPO?

    Elected members will consider the responses to the survey and decide whether the order will be in place 24/7, whether it will have timed restrictions or decide not to alter the existing PSPO at all.

    Has the Council considered disadvantaged/protected characteristic groups?

    Yes, as part of the consultation an Equality Impact Assessment will be completed and available as part of the publicly available report.
